Privacy Policy

This Privacy Policy explains how Be Nexxt Inc. collects, uses, discloses, and retains personal information through www.benexxtinc.com and related communications. The Site is informational and lead-generating; it does not currently provide accounts, online payments, subscriptions, public AI tools, or Dominion access.

1. Scope and Who We Are

This Privacy Policy applies to personal information Be Nexxt Inc. (“Be Nexxt,” “we,” “us,” or “our”) processes when you visit www.benexxtinc.com (the “Site”), submit an inquiry, request a meeting, join our mailing list, communicate with us, or interact with us in a business-development context.

It does not replace privacy terms in a client agreement, statement of work, nondisclosure agreement, employment notice, or other relationship-specific notice. When Be Nexxt processes information solely on a client’s behalf, the client ordinarily determines the purposes and means of that processing, and the applicable client agreement governs.

2. Personal Information We Collect

Information you provide

  • Contact-form information: name, company, professional title, telephone number, and the state in which your business operates.
  • Mailing-list information: email address, consent or signup record, engagement with messages, unsubscribe status, and related preferences.
  • Communications and inquiry content: information you choose to provide by email, telephone, meeting request, contact form, or other communication.
  • Business relationship information: organization, role, professional interests, meeting history, proposal activity, and information needed to evaluate or manage a prospective or existing engagement.

Please do not submit passwords, payment-card information, protected health information, government identification numbers, trade secrets, regulated data, or other highly sensitive or confidential information through a general inquiry. The Site is not designed to collect sensitive personal information.

Information collected automatically

When you visit the Site, Wix and other infrastructure providers may automatically collect technical and usage information, such as IP address, browser and device type, operating system, referring page, pages viewed, dates and times, approximate location derived from IP address, error logs, security events, and cookie or similar-technology identifiers.

Information from other sources

We may receive professional contact information from your employer or colleagues, referrals, event organizers, public business sources, service providers, and platforms you use to communicate with us. We use that information only for legitimate business-development, relationship-management, security, and legal purposes described in this Policy.

3. How We Use Personal Information

  • respond to inquiries, schedule conversations, and evaluate potential engagements;
  • provide, administer, and support client or business relationships;
  • send newsletters and marketing communications when you subscribe or otherwise authorize them;
  • operate, maintain, troubleshoot, protect, and improve the Site and our communications;
  • understand Site traffic, campaign performance, and audience engagement using appropriately configured analytics;
  • prevent fraud, misuse, security incidents, and violations of our Terms and Conditions;
  • maintain business, consent, suppression, and compliance records; and
  • comply with law, enforce agreements, establish or defend legal claims, and respond to lawful requests.

We may combine information collected through these sources when reasonably necessary for the purposes above. We do not use Site visitor or prospect personal information to train public artificial-intelligence models.

4. Marketing Communications

Visitors may join the Be Nexxt mailing list through a dedicated form or by affirmatively selecting a marketing-consent option on a contact form. Mailchimp may process email addresses, signup details, consent records, message-delivery information, and engagement data on our behalf.

You may unsubscribe at any time using the link in a marketing email or by contacting theresa@benexxtinc.com. We will honor valid email opt-out requests and may retain a minimal suppression record so we do not add you back to marketing lists. Opting out of marketing does not prevent necessary non-marketing communications about an inquiry, engagement, or legal matter.

5. Cookies, Analytics, and Planned Tracking

The Site and its hosting infrastructure may use cookies and similar technologies that are necessary for security, network management, fraud prevention, accessibility, preference storage, and basic operation. Your browser may allow you to delete or block cookies, but doing so can affect Site functionality.

Be Nexxt plans to add Wix Analytics, Google Analytics, Meta Pixel, LinkedIn Insight Tag, Google Ads tracking, Hotjar or comparable session-analytics technology, embedded YouTube or Vimeo content, and Calendly or another meeting scheduler. These technologies may collect device identifiers, IP address, browser data, pages viewed, referring URLs, interactions, event data, approximate location, video engagement, or scheduling information, depending on configuration.

Not all planned technologies are active as of the Last Updated date. Before activating nonessential analytics, advertising pixels, or session-recording technology, Be Nexxt will implement an appropriate cookie notice and preference mechanism and update this Policy if the change materially affects our practices. Session-recording tools will be configured, where reasonably available, to suppress form fields and sensitive inputs.

Be Nexxt does not currently sell personal information or share it for cross-context behavioral advertising. Planned advertising tags will not be configured for cross-context behavioral advertising unless Be Nexxt first updates its disclosures and implements legally required opt-out controls, including recognition of applicable browser-based opt-out signals.

6. How We Disclose Personal Information

We may disclose personal information to the following recipients for the purposes described in this Policy:

  • service providers that host, secure, maintain, analyze, or support the Site and communications, including Wix and Mailchimp;
  • business-productivity and storage providers, such as Google One, when used to manage communications or records;
  • professional advisers, including lawyers, accountants, insurers, auditors, and security advisers;
  • a prospective or actual buyer, investor, successor, or transaction adviser in connection with a merger, financing, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards; and
  • government authorities, courts, counterparties, or other persons when reasonably necessary to comply with law, protect rights or safety, prevent fraud, enforce agreements, or establish or defend legal claims.

Be Nexxt also uses business tools that may include Shopify, PayPal, ChatGPT and other OpenAI services, Kling, Lovable, Cowork, and related technology. PayPal and Shopify are not currently connected to Site checkout, and the Site does not process online payments. Be Nexxt does not place Site visitor or prospect personal information into ChatGPT, Kling, Lovable, Cowork, or other AI-generation tools.

We do not sell personal information. We do not disclose personal information to third parties for their own direct marketing or share it for cross-context behavioral advertising under our current practices.

7. Artificial Intelligence and Dominion

The Site does not currently permit visitors to submit prompts or files to an AI system, receive automated AI outputs, or access Dominion. Descriptions of AI capabilities or Dominion do not mean that Site visitor information is submitted to those systems. Any client-facing processing involving AI or Dominion will be governed by the applicable client agreement and related privacy or security terms.

8. Retention

We retain personal information only for as long as reasonably necessary for the purpose collected, including legal, accounting, security, dispute-resolution, and recordkeeping needs. Our standard targets are:

  • general inquiries and prospect communications: two years after the last meaningful interaction;
  • marketing records: until you unsubscribe or after two years of inactivity, with a minimal suppression record retained as needed to honor your choice;
  • client and business records: generally seven years after the engagement ends, unless a contract, legal hold, tax rule, dispute, or shorter operational need requires a different period; and
  • technical and cookie data: according to the purpose and configuration of the applicable technology, with nonessential cookie durations ordinarily limited to no more than 13 months unless a longer period is justified and disclosed.

We may retain aggregated or deidentified information that cannot reasonably identify you. When retention is no longer justified, we delete, deidentify, or securely isolate the information as appropriate.

9. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No website, transmission, or storage system can be guaranteed completely secure. You are responsible for choosing appropriate channels and avoiding highly sensitive information in general inquiries. If you believe information you provided to us has been compromised, contact us promptly.

10. Your Privacy Choices and Rights

Depending on where you live and subject to legal exceptions, you may have rights to request access to, correction of, or deletion of personal information; obtain information about collection, use, and disclosure; receive a portable copy; opt out of certain processing; withdraw consent; or appeal a denied request. You may also unsubscribe from marketing as described in Section 4.

To submit a request, email theresa@benexxtinc.com or write to the address in Section 15. Describe your request and the relationship through which Be Nexxt collected your information. We may need to verify your identity and authority. An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification. We will not discriminate against you for exercising applicable privacy rights.

11. California Privacy Notice

California residents may have rights under the California Consumer Privacy Act, as amended, if and to the extent it applies to Be Nexxt or the relevant processing. During the preceding 12 months, Be Nexxt may have collected the categories described in this Policy: identifiers and contact information; professional or employment-related information; internet or electronic activity; approximate geolocation derived from IP address or the state supplied with an inquiry; communications and business-relationship information; and limited inferences about professional interests.

We collect these categories from you, your device, business referrals, public professional sources, and service providers. We use and disclose them for the business purposes described in Sections 3 and 6. We do not knowingly collect sensitive personal information through the Site for purposes that require a right to limit its use.

Be Nexxt has not sold personal information or shared it for cross-context behavioral advertising during the preceding 12 months. We do not knowingly sell or share personal information of individuals under 16. Because our current practices do not involve sale or sharing, the Site does not currently provide a “Do Not Sell or Share My Personal Information” link. If our practices change, we will update this notice, provide the required opt-out method, and honor applicable Global Privacy Control signals.

California’s “Shine the Light” law may permit residents to request information about certain disclosures for third parties’ own direct-marketing purposes. Be Nexxt does not make such disclosures under its current practices.

12. Children’s Privacy

The Site is intended for a professional and business audience and is not directed to children under 18. We do not knowingly collect personal information from children through the Site. If you believe a child has provided personal information, contact us so we can review and delete it as appropriate.

13. United States Audience

Be Nexxt operates from California and does not intentionally market the Site to individuals in the European Union, United Kingdom, Canada, or other non-U.S. jurisdictions. The Site may nevertheless be accessible globally. If you access the Site from outside the United States, information may be processed in the United States, where privacy laws may differ from those in your location.

14. Changes to This Policy

We may update this Privacy Policy as our Site, tools, or legal obligations change. The revised version will display a new Last Updated date. If a change materially affects how we use information already collected, we will provide additional notice or obtain consent when required. Planned tracking technologies described in Section 5 will be accompanied by updated controls and disclosures before material activation where required.
